An Enduring Power of Attorney Form, sometimes called a Durable Power of Attorney Form, is used to protect a person’s interests and conduct their affairs if they should become physically or mentally incapacitated.  You can also use one if you would like a trusted person to manage your affairs while you concentrate on other aspects of your life.

Many people with severe illnesses or progressive debilitating diseases sign an Enduring Power of Attorney Form so when they are no longer able to handle their own business affairs, they can have the person (agent) of their choice in charge.  Similarly, those that know they are in danger of being incapacitated by mental illness or Alzheimer’s use a Durable Power of Attorney Form.  This can insure that their assets are well taken care of, their own needs are met and no one can take advantage of their diminished capacity.

If you do not have a Durable Power of Attorney Form and you are no longer able to manage your own affairs, a probate court will establish a guardianship or conservatorship for you.  That eliminates your choices and may ultimately go against your wishes.  A Durable Power of Attorney form is much less costly and preserves your choices.

If your agent will be handling your property sales or acquisitions you should file a copy of your POA with the Registry of Deeds in your county courthouse.  This will make things go more smoothly for your agent.

An Enduring Power of Attorney Form or Durable Power of Attorney Form gives your agent the powers you grant him or her over your business affairs but they are required to keep their finances completely separated from yours.  They are not allowed to profit from any business they do for you and must keep accurate records of all transactions. They cannot take any of your personal property or money unless the POA says they can.  As you can see, there are protections built into this form and the laws that allow it.

You can revoke it whenever you choose if you are of sound mind.  Just write or type a statement saying you are of sound mind and wish to revoke it.  Include the date the POA took effect, name your agent then sign and date it.  Send it to your agent and every business that you patronize.  You are then free to conduct your own affairs or choose a different agent.
